Reporting Fraudulent, Dishonest, or Unlawful Behavior
Marymount Manhattan College is committed to providing a safe and productive environment for all members of the College community. The College's internal controls and operating procedures are intended to deter activity that is contrary to College policy, or in violation of federal, state and local laws and regulations. It is the College's responsibility to investigate matters that may represent violations of laws, regulations, policies and procedures.
In view of this, Marymount Manhattan encourages all members of the College community to express their concerns about:
- Fraud and financial irregularities.
- Activities endangering the health and safety of College community members or others.
- Any criminal activity.
- Any violation of applicable law.
- Failure to comply with legal obligations.
- Unlawful Discrimination or illegal workplace behavior.
- Unethical or dishonest conduct.
If a member of the College community has a good faith basis to believe or to reasonably suspect the occurrence of illegal, improper, or unethical conduct or activity, that person may report such action or activity without fear of reprisal or retaliation. Individuals are encouraged to come forward in good faith with genuine concerns. However, knowingly false accusations of misconduct shall be subject to disciplinary action.
Allegations of wrongdoing shall be investigated and appropriate action taken. All members of the College are required to cooperate fully with any internal or external investigation, and shall maintain the confidentiality of any investigation and related documentation, unless specifically authorized to disclose such information.
Any person who takes any action whatsoever in retaliation against a member of the College who has in good faith raised any question or concern under this policy shall be subject to serious sanctions, which may include termination of employment. Encouraging others to retaliate is also a violation of this policy.
If you are unsure about the best course of action, you should consult with your immediate superior, the Director of Human Resources or the Vice President of Administration and Finance. If you are not comfortable raising an ethical issue or discussing a possible or actual violation with any of the foregoing resources, you should report the matter by sending a sealed letter to Judson R. Shaver, PhD, President, Marymount Manhattan College, 221 East 71st Street, New York, New York 10021. You may also contact the Board of Trustees by sending a sealed letter addressed to the Chair of the Audit Committee, c/o Marymount Manhattan College, 221 East 71st Street, New York, New York 10021.
Reports can be made confidentially, but the College will investigate such reports and the promise of confidentiality is limited by the need to investigate. Although complete confidentiality cannot be assured, depending upon the nature of the complaint and the need to investigate, every effort will be made to protect the confidentiality of the source within the bounds of the law.
